Case Study – The $600,000 Buy Back

They Brought In the Bikies, Forged Documents and Played Games - They All Had to Pay

It was an injustice – the Sherrif was at the door – soon the bikies arrived. They had come for the car, they had come for the house.

They broke all the rules – and they thought they’d get away with it.

The bank said they sent a letter by mail (they never did). The process server said he served the repossion notice (that was proven to be a lie as you’ll soon see).

They told the Sherrif the client had moved to a new house (he didn’t).

The client was scared, without a house – his car reposessed through violance and intimidation.

He made the call.

Adam Watson knew that whenever a bank reposess a property – they are sloppy. In finance – every mistake you make – (missed or delayed payment) etc. – you have to pay.

But debtors don’t know that by the same token – every mistake the bank makes in reposession, false credit reporting or incorrect serving of documents also means the bank has to pay – and the bank does not want the trouble.

Adam Watson had come in to a client who had paid $10,000 (approximately) of a $600,000 property – which was then reposessed. He didn’t have the property – and his $47,000 vehicle was also taken from him and his credit history was in shambles.

The client was just wishing he could have his credit history repaired – as the only reason for the reposession was the wrong debit date given by the bank – the client had the money – he just didn’t know. A small technical mix up had cost him the Australian dream – it was unfair.

The Strategy
The Process Server Lied

The first thing Adam Watson did was subpeona the metadata of the process server’s phone – who had claimed in an Affadavit of Service to the Court that he had served a Statement of Claim. This metadata can track the pings from cell phone towers to know your precise location throughout the day (bet you didn’t know that).

The metadata proved that the process server was never in the vicinity at the time and place that the Statement of Claim was supposedly served. So that was a lie.

The Sherrif's Warrant of Reposession Was Wrong
(The Mercantile Agent Lied)

The major bank who had provided the sherrif with the warrant of reposession lied (that or they made a very big mistake which added to a “pattern” of so many mistakes, half truths and misdirections).

The Sherrif had been informed that the client had all ready moved to a new address (which was given to him) and the property was ready to be repossessed – however the client not only was still at the address, but had no idea about the reposession.

The “new address” that was given by the bank to the sherrif was a dummy address – you could have gotten it from a random address search – the person at the address did not know the client or knew why they were listed.

"We'll Burn Your House Down!" (The Bikies Get Involved)

It was not just the house reposession that threw the client for a loop.

Earlier the mercantile agent had rolled up to the property – with a full bikie force in tow (along with all the patches).

Even though mercantile agents are licensed by the police – the friends they keep leaves a lot to be desired – and they benefit from the intimidation factor when repossessing – a big no, no.

Unfortunately for them they were recorded – and since they were sent by the bank the question became whether the bank was aware that they were sending Bikies to reposess client’s cars.

And these questions started being asked by the Major Crime Unit who got involved because these bikies were wanted for other crimes – and when combined with the lies from the process server, the address irregularities handed to the Sherrif – let’s just say everything started to stink to high heaven around this major bank.

And the CEO was involved – and was ready to settle – and pay any money to make all of this go away.

Resolution
"With all Due Respect that's not My Problem"

The client was clear – he wanted his old house back… and he wasn’t going to pay for it.

The bank had made so many mistakes – and they were lucky if this wouldn’t end up in a criminal investigation of the higher echelons of the bank itself. Heads would have to roll.

With a swift call the bank folded – the client would get his old house back (the bank attempted to protest that it would cost 1.5 million to buy it back from the current owner – a 150% increase from the original price) – Adam Watson had made it very clear “with all due respect that’s not my problem”.

The client would not just get his old property back – FULLY PAID OFF – but also the purchase price of his vehicle for a brand new sparkling car in the Deed of Settlement.

There are “credit repair specialists” – and there are killers who make the bank PAY.

This is the difference – and there are some that can see – and others that can’t.

Second Chances

On Domestic Violence?

Second chances on domestic violence and sexual assault? That’s a quick way to hollow out and ruin a country. No second chances with domestic violence and sexual assault on my watch – and definately not on immigrants whose job it is to work to make a good impression – not treat Australia like a punching bag.

The big question is – what does a detainee have to do to get sent home? Who disagrees with this? Stopping domestic violence starts with zero tolerance and a strong message needs to be sent – if you come to our country and assault and hit women – you are not welcome on our shores.

John Laws’ biggest concern is that I’m wound up – I think the country needs to stop worrying about how we say things and start worrying about what is happening to women in this country by thugs who have no repurcussions for their actions.

(University) Financial Interests over Safety of Women?

International Students + AVO's?

Not in our Australian Character

International students with AVO’s are being allowed to stay in the country – so what kind of message does that send to the women in our community about how much we value their safety?

John Laws says talking about it is good – but that’s a cop out – everyone wants to talk about domestic violence because it makes them look good. But no one wants to make the tough decisions and put the gavel down – minimum 5 year terms for AVO’s.

“How do you do it? How do you stamp it out?” John Laws asks me after I just told him. Maybe the radio cut out?

A Forestcue owned mine was facing the horrible prospect of being completely shut down unless a government imposed fine was paid. The fine was $100 million – to be imposed by The Department of Mines, Industry Regulation and Safety (DMIRS).

What struck me was not only how Adam Watson was able to navigate this tricky situation and keep the mine open – but just how much respect and good will the Mines Department has for Mr. Watson.

Adam understands the power of relationships – and doing good by people always. His honesty and work ethic is beyond reproach – and most importantly the Forestcue mine is still open, operating and people are employed and everyone is happy.

Adam is my first port of call in dealing with tricky situations where lots of money (and jobs) are on the line.
